| CaribSurf Personal Web Pages - Terms of Use |

Cable & Wireless (Barbados) Limited’s Dial Up and High Speed Internet Access Terms and Conditions of Service, the CaribSurf Acceptable Use Policy and the terms of use below must be complied with by all CaribSurf customers who create Personal Web Pages and use CaribSurf’s facilities to host and facilitate the viewing of the same.
- The use of any lewd, offensive, profane, indecent, defamatory, libelous, slanderous, obscene, abusive, menacing, threatening, immoral words and/or phrases as part of the URL (Universal Resource Locater) for your Web Page is strictly prohibited and CaribSurf will not allow the use of any URL(s) containing such material.
- You are solely and totally responsible for the Content appearing on your Web page(s) (i.e. all information, data, text, images, video, graphics, sound, music, photographs, postings, messages, logos, trademarks, service marks and any other materials or information appearing on your Web Page including links to other Web Sites). You assume sole responsibility for the accuracy of the Content and other materials and information appearing on the Web Page. You further warrant and represent that you are the owner of the Content and all Intellectual Property Rights in the same including but not limited to copyright and you have the right to place the Content on the Web Site;
- You warrant that:
- the Content, material, messages, data and information appearing on or made available through the Web Page does not and will not contain any material that is inaccurate or that violates any applicable law, rule or regulation or that infringes upon any common law or statutory right of any person or entity, including without limitation any proprietary, contract, moral, privacy or publicity right, copyright, patent, trademark, trade secret or any other third party right, or constitutes an invasion of privacy or violates a right of privacy;
- the Content, material, messages, data and information appearing on or made available through the Web Page does not and will not contain any material that in our good faith judgment is obscene, threatening, malicious, defamatory, libelous, slanderous, pornographic or which otherwise could expose us to criminal or civil liability;
- you have verified the accuracy of the Content, material, messages, data and information appearing on or made available on the Web Page; and
- you have obtained any authorization(s) necessary for hypertext links from your Web Page to other third party Web Sites.
- We will not systematically review the Content, but we reserve the right to to block access to your Web Page(s), remove the Content on your Web Page(s), or suspend or terminate your account if the Content violates the Cable & Wireless (Barbados) Limited’s Dial Up and High Speed Internet Access Terms and Conditions of Service, the CaribSurf Acceptable Use Policy and these Terms of Use.
- You agree to defend, indemnify and hold us, our employees, affiliates and agents harmless from any and all claims, suits, proceedings, investigations, liabilities, judgments, losses, damages, expenses or cost (including attorneys' fees and investigation expenses) that directly or indirectly result from, arise out of or relate to: (i) any violation of the Cable & Wireless (Barbados) Limited’s Dial Up and High Speed Internet Access Terms and Conditions of Service, the CaribSurf Acceptable Use Policy and these Terms of Use by you; (ii) infringement or violation of any person's property, contractual or other proprietary rights, including copyright, patent, trade secret and trademark rights; (iii) any Content supplied by you which infringes or allegedly infringes the proprietary rights of a third party; or (iv) any breach or alleged breach of your representations and warranties made under this Agreement. You also agree to pay our reasonable attorneys fees and other costs incurred in enforcing this clause.
If you wish to include your e-mail address on your page, please be aware that Web crawlers can visit your page, pull the e-mail address and proceed to use it in mass e-mailings or spam that you may not want.
Keep a copy of your Web Page(s) on either your hard drive or on a disk for any possible future changes/revisions.
